Driving Instructor Licence Appeal Allowed at Parramatta Local Court

National Criminal Lawyers® successfully represented a driving instructor in an appeal against Transport for NSW, resulting in the Local Court allowing the appeal and ordering that a driving instructor licence be issued subject to conditions.

Successful Driving Instructor Licence Appeal Against Transport for NSW

The appeal arose after Transport for NSW refused our client’s application to renew his driving instructor licence. The refusal was based on his traffic record and Transport for NSW’s view that, having regard to that record, it was not in the public interest for him to hold a driving instructor licence.

National Criminal Lawyers® prepared and conducted the licence appeal in the Local Court of NSW at Parramatta. On 10 September 2026, the Court allowed the appeal. Transport for NSW was ordered to issue the driving instructor licence, subject to conditions directed to future traffic compliance and completion of a Traffic Offenders Intervention Program.

Why Transport for NSW Refused the Driving Instructor Licence Renewal

Transport for NSW identified six speeding offences between January 2022 and March 2025. Five involved speeding by not more than 10 km/h, including a camera-detected school-zone offence, while one involved exceeding the speed limit by more than 20 km/h but not more than 30 km/h. Transport for NSW had also issued a demerit-points warning letter in September 2025.

Transport for NSW relied on section 18 of the Driving Instructors Act 1992 (NSW), including the public-interest consideration concerning an applicant’s record of motor-vehicle offences. Its reasons emphasised the position of trust held by driving instructors and the importance of safe driving, respect for traffic laws and public confidence in those who teach learner drivers.

Appealing a Refused Driving Instructor Licence in NSW

A refusal of a driving instructor licence can, in appropriate circumstances, be appealed to the Local Court under the Driving Instructors Act 1992 (NSW). The appeal must ordinarily be lodged within 28 days of notification of the decision and must specify the grounds relied upon.

On appeal, the Local Court may confirm, vary or disallow the Transport for NSW decision, or make another order that appears just. The civil standard of proof applies that is “on a balance of probabilities”. This makes the preparation of the appeal material, the applicant’s evidence and the submissions addressing the statutory concerns particularly important.

How National Criminal Lawyers® Prepared the Licence Appeal

The appeal was prepared to address the public-interest concerns raised by Transport for NSW while placing the client’s traffic history in the context of his professional record, insight and subsequent conduct.

The material relied upon included a detailed apology to the Court in which our client accepted responsibility for his traffic history and acknowledged the higher standard expected of a professional driving instructor. He explained practical changes made after receiving the demerit-points warning, including allowing more time between lessons and appointments rather than placing himself under time pressure while driving.

The Court was also provided with character material and extensive feedback concerning the client’s work as a driving instructor. The material addressed his patience, professionalism, safety-focused teaching, clear instruction and the confidence he had given learner drivers and their families.

Importantly, the appeal focused not merely on the existence of the historical traffic offences, but on whether the client should now be permitted to continue working as a driving instructor having regard to the evidence as a whole and the safeguards available to the Court.

The Result: Driving Instructor Licence Appeal Allowed

The Local Court at Parramatta allowed the appeal on 10 September 2026. The Court ordered Transport for NSW to issue a driving instructor licence to our client subject to two principal conditions:

  • The client must not incur two or more demerit points during the next 12 months and must notify Transport for NSW in writing within seven days of incurring any demerit points.
  • The client must enrol in and successfully complete a Traffic Offenders Intervention Program within three months and provide Transport for NSW with written evidence of successful completion within seven days.

The result enabled our client to obtain his driving instructor licence notwithstanding the earlier refusal by Transport for NSW, while imposing conditions designed to reinforce future compliance and road-safety obligations.

What This Case Shows About Transport for NSW Licence Appeals

A Transport for NSW refusal does not necessarily mark the end of a driving instructor licence application. Where a right of appeal exists, the Local Court can reconsider the decision and the material bearing upon the applicant’s suitability and the public interest.

A properly prepared driving instructor licence appeal may require careful analysis of the traffic record, the statutory basis for refusal, the timing of any warning or subsequent offending, the applicant’s professional history, evidence of insight and rehabilitation, character references and objective material demonstrating safe professional practice.

Every licence appeal turns on its own facts. Past traffic offences remain important, particularly where the applicant’s occupation involves teaching road safety, but the Court can consider the broader evidentiary picture when determining the appeal.
